Terms of service
The rules for using Dashly: who may open an account, what may be done with the service, who owns what, and when access can be suspended. Commercial conditions are set out separately in the terms of sale.
01Purpose and acceptance
These terms govern access to and use of the Dashly website and application, published by BEBRANDED ("we", "us"). Creating an account or using the service means accepting them in full.
They apply to the agency that subscribes, to every member of that agency, and to the client users the agency invites into its portal.
02Who may use the service
The service is intended for professionals acting in the course of their business. It is not offered to consumers. By opening an account you confirm that you are acting on behalf of a business and that you have the authority to bind it.
You must be at least 18 years old and legally able to enter into a contract.
03Accounts and access
- An account is personal. Credentials must not be shared, and an agency seat must not be used by several people in turn to avoid paying for a second seat.
- You are responsible for keeping your credentials secret and for everything done from your account. Two-factor authentication is available and recommended.
- The agency's administrators decide who joins the workspace, what each member may see, and which client users are invited into the portal.
- Tell us without delay at contact@usedashly.com if you suspect unauthorised use of an account.
04Your content, and your responsibility for it
Everything you put into the service — client records, documents, messages, files, proposals — remains yours. We claim no ownership over it and use it only to operate the service for you.
You are responsible for that content: for having the right to hold it, for its lawfulness, and for informing the people concerned as data protection law requires. Where the content includes personal data, you act as controller and we act as processor, as described in the privacy policy.
05Acceptable use
You agree not to:
- use the service for anything unlawful, or to store content that infringes the rights of others;
- attempt to access another agency's workspace, probe the security of the service, or circumvent its access controls;
- reverse engineer, decompile or copy the software, except to the extent the law expressly permits;
- resell or make the service available to a third party outside the client portal it provides;
- use the crawling and SEO tools against a website you neither own nor have permission to analyse;
- send unsolicited bulk email through the service, or use it to distribute malware;
- place a load on the service that is manifestly disproportionate to normal professional use, including automated calls to the public API beyond its published limits.
06Third-party integrations
The service can connect to third-party tools such as Google, Slack, WhatsApp, Stripe, Webflow, Ahrefs or Fathom. Those connections are optional, are made by you, and are governed by the terms of the provider concerned.
We are not responsible for a third-party service becoming unavailable, changing its interface or ending its programme, nor for what that provider does with data you instruct us to send it. A connection can be revoked at any time from the application.
07Availability and changes
We work to keep the service available continuously, but we do not guarantee uninterrupted or error-free operation. Maintenance may make the service temporarily unavailable; where it is planned and significant, we give notice in advance.
The service evolves. Features are added, changed and occasionally withdrawn. If a feature you rely on is to be removed, we give reasonable notice to account holders by email.
08Our intellectual property
The Dashly software, its interfaces, its documentation, its name and its visual identity belong to BEBRANDED. Your subscription grants a personal, non-exclusive, non-transferable right to use the service for its duration, and nothing more.
Feedback and suggestions you send us may be used freely to improve the product, without that creating any obligation towards you.
09Suspension and termination
We may suspend access, in whole or in part, where use breaches these terms, threatens the security or stability of the service, or where an invoice remains unpaid under the terms of sale. Except in an emergency, we give notice and a reasonable opportunity to remedy the situation first.
You may stop using the service at any time. The consequences of ending a paid subscription — notice, final period, invoicing — are set out in the terms of sale.
After termination, your data remains available for export for 30 days, and is then deleted from active systems. Backups are erased in the ordinary rotation, within 90 days at most.
10Liability
We are bound by an obligation of means. We are liable for direct damage resulting from our own fault, and our total liability over any twelve-month period is limited to the amounts you paid for the service during that period.
We are not liable for indirect damage such as loss of profit, loss of business or loss of opportunity, nor for damage resulting from your own use of the service, from content you introduced, or from a third-party service you connected. Nothing in these terms excludes liability that the law does not allow to be excluded.
Keeping your own export of critical data is your responsibility; the service provides export functions for that purpose.
11Changes to these terms
These terms may be amended. Account holders are informed by email at least 30 days before a substantial change takes effect. Continuing to use the service after that date constitutes acceptance; if you do not accept, you may terminate under the terms of sale.
12Governing law and jurisdiction
These terms are governed by French law. Any dispute that cannot be settled amicably will be brought before the courts of Bobigny, France, notwithstanding multiple defendants or third-party proceedings.
